I. Scope

These General Terms and Conditions apply to all declarations of intent, contracts and legal transactions between Chayas and the customer in the version valid at the time of the respective order when purchasing via the Chayas online shop.

The offers in the Chayas online shop are directed exclusively at consumers within the meaning of § 13 BGB (German Civil Code).

Conflicting or deviating terms of the customer shall not be recognized unless expressly agreed in writing by Chayas.

II. Contractual Partner, Conclusion of Contract

The purchase contract is concluded with Chayas.

The presentation of products in the online shop does not constitute a legally binding offer. By placing an order, the customer submits a binding offer. The contract is concluded upon acceptance by Chayas or delivery of the goods.

III. Contract Language, Storage

Available contract languages are German and English. The contract text is stored and sent via email.

IV. Prices and Delivery

All prices include statutory VAT and exclude shipping costs.

Shipping costs are displayed during checkout. Chayas may make partial deliveries if reasonable.

V. Payment

Payment methods include:

– Credit card
– PayPal
– Instant bank transfer

VI. Retention of Title

Goods remain the property of Chayas until full payment has been received.

VII. Right of Withdrawal

Consumers have a statutory right of withdrawal of 14 days.

To exercise this right, customers must notify Chayas (info@chayas.de).

The customer bears the cost of return shipping.

Refunds are made within 14 days after receipt of the withdrawal notice and returned goods.

VIII. Transport Damage

Visible transport damage should be reported immediately to the carrier and to Chayas.

IX. Warranty

Statutory warranty rights apply. The limitation period is two years from delivery.

X. Liability

Chayas is liable in accordance with statutory provisions for intent and gross negligence. In other cases, liability is limited to foreseeable damages.

XI. Set-off

Set-off is only permitted with undisputed or legally established claims.

XII. Copyright

All content on the website is protected by copyright.

XIII. Applicable Law, Jurisdiction

German law applies. The UN Convention on Contracts for the International Sale of Goods is excluded.

Chayas is not obliged to participate in dispute resolution proceedings.
